The client desired to setup a secondary plastic packaging unit in Gujarat, India and required about 13 acres of land, which was available in small lots and owned by 10 different vendors. As per the system prevailing locally, landowners would give a revocable Power of Attorney to a middleman who would deal with the buyer and could sign all the land documents. SKP identified and informed the client of the grave risk of such a transaction since the title of land so acquired would be very questionable and unsafe. The client not aware of the serious implications of an imperfect land title and based on local advice had planned to go ahead with the matter.
SKP prevailed upon the client and the landowners, ensuring that all the land documents were signed personally by the individual sellers and not the Power of Attorney holder. The owners also signed all the land registration documents. By following SKP’s advice, the client was able to achieve a very good title to the land.
