CASE STUDY II - Indian subsidiary of US based company focused on providing software solutions

The company had filed its return of income and its case was selected for scrutiny. During the preparation stage for the proceedings, SKP identified an incorrect claim, unknowingly made by the company to the tune of US $ 240000 approx. Consequently the Assessing Officer contested the allowability of the claim.

SKP did extensive research on the issue, studied the guidance note and other relevant material and case laws on the subject, distinguished the facts of the case with those of the others and convinced the Tax Authorities regarding the allowability of the claim. This resulted in a tax saving to the company of US $ 85000 and penalty of equal amount.
